Telehealth Consent & PHI Disclosure Notice

Docty Healthcare India Pvt Ltd (“Docty”) offers healthcare services via telehealth, which includes but is not limited to:

  • Interactive live video consultations

  • Remote patient monitoring

  • Secure image/data transmission (“store and forward”)

  • Mobile device-based medical assessments

These technologies allow patients and healthcare professionals to interact when in-person visits are not possible or necessary. The use of telehealth is intended to increase accessibility, convenience, and continuity of care—but is not a substitute for all medical evaluations.

Your Informed Consent to Use Telehealth Services

By proceeding with a telehealth appointment through Docty, you acknowledge and agree to the following:

  1. Use of Electronic Communication
    I understand that medical care may be delivered via mobile phone, computer, tablet, or similar electronic device through video, audio, or digital media.

  2. No Recording Without Consent
    I acknowledge that I will not be recorded (video/audio/photo) during any telehealth interaction unless I give express consent.

  3. Clinical Limitations of Telehealth
    I understand that:

    • Physical exams may not be performed.

    • My provider may request an in-person consultation for further diagnosis.

    • A provider may be off-screen or unavailable at times.

    • Either party may discontinue a telehealth session if the technology fails or care cannot be adequately delivered.

  4. Right to Decline or Withdraw
    I have the right to:

    • Refuse telehealth services without impacting my access to general healthcare.

    • Withdraw my consent at any time by written request.

  5. Privacy & Security
    I understand that my information is protected under Indian privacy laws and applicable standards similar to HIPAA (Health Insurance Portability and Accountability Act). My personal and medical information will not be disclosed without my permission, except as required by law.

  6. Billing and Charges

    • I may receive multiple bills (e.g., from the platform and the individual provider).

    • I acknowledge responsibility for any out-of-pocket charges, co-pays, deductibles, or full payment in the absence of insurance coverage for telehealth.

    • My telehealth provider may be an independent consultant and not an employee of the hospital or facility I am currently connected with.

Protected Health Information (PHI): Use and Disclosure

Docty is committed to the secure handling of your Protected Health Information (PHI) in accordance with applicable Indian data privacy standards.

Permitted Uses and Disclosures

We may use or disclose your PHI for the following purposes:

  1. Treatment
    PHI may be shared with healthcare providers involved in your care for consultation, treatment planning, or referrals.

  2. Payment
    PHI may be shared with your insurer, third-party payer, or billing partners for claims processing, reimbursement, or coverage inquiries.

  3. Healthcare Operations
    We may use PHI for:

    • Quality improvement

    • Internal audits

    • Patient support services

    • Staff training and compliance

  4. Third-Party Support
